Derecho a un juicio justo con el debido proceso

Abstract

La investigación realizada tuvo como objetivo determinar que a través de la aplicación de cada uno de los postulados que integran el debido proceso se puede lograr un juicio justo. La modalidad de investigación utilizada fue documental, apoyada en un estudio de carácter descriptivo y de campo. La población objeto de estudio la conformaron la totalidad de los abogados, entre Jueces, Fiscales del Ministerio Público y Defensores que conforman el Circuito Judicial Penal del Estado Aragua, de tal suerte que, no se realizó selección de muestra por estar en presencia de una población finita. El instrumento utilizado fue un cuestionario, el cual permitió obtener los datos requeridos para lograr los objetivos de la investigación. Los datos obtenidos a través de la aplicación del cuestionario a la totalidad de los Jueces, Fiscales y Defensores Públicos que conforman el Circuito Judicial Penal del Estado Aragua, fueron procesados mediante una tabulación de frecuencia porcentual izados y análisis descriptivo, lo que permitió llegar a la siguiente conclusión: El Debido Proceso, principio rector del sistema acusatorio, oral y público, ha de ser el norte en la actuación de los operadores de justicia, quienes deben no sólo conocerlo sino aplicarlo, garantizando con ello al imputado el respeto de todos los derechos que les son inherentes al ser humano y por ende, garantizarle un Juicio Justo

The objective of the research was to determine that through the application of each of the postulates that make up due process, a fair trial can be achieved. The research modality used was documentary, supported by a descriptive and field study. The population under study was made up of all the lawyers, including Judges, Prosecutors of the Public Prosecutor's Office and Defenders that make up the Criminal Judicial Circuit of Aragua State, so that no sample selection was made because it was a finite population. The instrument used was a questionnaire, which allowed obtaining the data required to achieve the research objectives. The data obtained through the application of the questionnaire to all the Judges, Prosecutors and Public Defenders that make up the Criminal Judicial Circuit of Aragua State, were processed through a tabulation of percentage frequency and descriptive analysis, which allowed the following conclusion to be reached: Due Process, the guiding principle of the accusatory, oral and public system, has to be the north in the actions of the operators of justice, who must not only know it but also apply it, thus guaranteeing the accused the respect of all the rights that are inherent to the human being and therefore, guaranteeing him a Fair Trial
