La redención judicial de la pena por el trabajo y el estudio en el proceso penal Venezolano

Abstract

La presente investigación tuvo como propósito, analizar la redención judicial de la pena por el trabajo y el estudio en el cumplimiento de la finalidad de la pena, en virtud de que el Código Orgánico Penitenciario establece esta fórmula alternativa, con la finalidad de lograr la rehabilitación y la reinserción del penado. En cuanto al tipo de investigación, este se corresponde al documental dentro de la modalidad jurídica dogmática, utilizándose además el método de análisis para descomponer el problema jurídico y como técnicas de investigación aquellas esencialmente documentales, con apoyo de las diferentes fuentes jurídicas directas y de las novedosas herramientas de la Internet. Al término de la investigación se concluyó que la redención judicial de la pena por el trabajo y el estudio, tal como ha sido establecida en este código en donde fue ampliada a otras actividades como culturales y deportivas, contribuye al cumplimiento de la finalidad de la pena, en los términos pautados en la Constitución de la República Bolivariana de Venezuela y el Código Orgánico Penitenciario

The purpose of this investigation was to analyze the judicial redemptionof the sentence for work and study in compliance with the purpose ofthe sentence, by virtue of the fact that the Organic Penitentiary Codeestablishes this alternative formula, with the purpose of achievingrehabilitation and the reinsertion of the prisoner. Regarding the type ofinvestigation, this corresponds to the documentary within the dogmaticlegal modality, also using the method of analysis to decompose thelegal problem and as research techniques those essentiallydocumentary, with the support of the different direct legal sources andthe new Internet tools.
