Implicancias criminalísticas y medico legales del infanticidio (caso: Dayan Gonzalez)

Abstract

El infanticidio se define como la muerte dada a un niño o infante. A pesar de que existen diferentes acepciones criminológicas y jurídicas alrededor del mundo, en Venezuela la acepción del mismo es de carácter agravante de un homicidio y se constituye principalmente cuando la muerte del infante es de un recién nacido o menor de un año y se realiza por cuestiones de “honor”. En el año 2011, en Guanare, portuguesa, ocurrió un infanticidio terrible hacia Dayan González, víctima de constantes abusos y maltratos físicos, psicológicos y sexuales hasta la fecha de su muerte. Entre los aspectos que llevaron a Dayan a su muerte se encuentra la antipatía y adultocentrismo de la sociedad que objetifica a los niños, la negligencia por parte algunos organismos de protección de menores y el constante abuso por parte de sus cuidadores y familiares. Es por eso que las experticias y actuaciones criminalísticas realizadas por los cuerpos policiales y forenses fueron cruciales para la reconstrucción de los hechos y la vinculación de los imputados con el delito

Infanticide is defined as the death given to a child or infant. Despite the fact that there are different criminological and legal meanings around the world, in Venezuela the meaning of the crime is of an aggravating nature of a homicide. It is constituted mainly when the death of the infant is a newborn or less than one year old and is carried out by matters of "honour." In 2011, in Guanare, in the state of Portuguesa, a terrible infanticide occurred against Dayan González, victim of constant physical, psychological, and sexual abuse and mistreatment until the date of his death. Among the aspects that led Dayan to his death are: The antipathy and adult-centrism of society that objectifies children. The negligence by some child protection agencies. The constant abuse by his caregivers and family members. That is why the expertise and criminal actions carried out by the police and forensic forces were crucial for the reconstruction of the facts and the connection of the accused with the crime
